Notwithstanding anything contained in this Privacy Policy or elsewhere, RMI India Foundation shall not be held responsible for any loss, damage or misuse of Your Information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below).

 

A “Force Majeure Event” shall mean any event that is beyond the reasonable control of RMI India Foundation and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, lock-outs, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer, computer system or computer network, computer crashes, breach of security and encryption, power or electricity failure or unavailability of adequate power or electricity.

 

Notwithstanding anything to the contrary, Your right to claim damages shall be limited to the right to claim only statutory damages under Information Technology Act, 2000 and You hereby waive and release RMI India Foundation from any claim of damages under contract or under tort.

i. Option not to provide Information / Withdrawal of consent

You have an option not to provide all or any of the Information to RMI India Foundation. By using the Website, You consent to the collection and use of Your Information in the ways described in this Privacy Policy.

 

In some situations when We may seek Your consent for processing, in such case, You will have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
